There are a great number of rules and restrictions laid out in our founding document(s). The following is no substitute for reading, understanding and following them. The Board and ACC take great care to reasonably enforce them. Typically, we have taken a reactive stance – responding and addressing violations brought to our attention. The most frequent violations get a more proactive response in that we will periodically check for compliance.
The 10 Most Common Violations/Complaints:
- Trash/recycle bins and screening
- Signs in yards (political or otherwise)
- Lawn maintenance (cutting, edging, weeds)
- Unapproved exterior alteration (sheds, fences, pools)
- Free roaming pets (cats and dogs)
- Owners not picking up after their pets
- Fireworks
- Pool problems – messes not picked up, drinks in or near pool, unruly behavior
- Lawn clippings blown into the street, drains or dumped on another property
- Street parking
There are a few guidelines published by the ACC (HERE). The Board has made no changes, additions or deletions to the covenants filed with the Probate Court back in 2008. We have made just two clarifications/interpretations:
- Street parking is prohibited – but a complete and absolute ban is not reasonable. Therefore, the Board accepts that it may occur “infrequently and of a short duration”.
- Trash cans are to be located or screened so as to be concealed from view of neighboring streets and property. Reasonable concealment is deemed to be:
- Located in a garage or ACC approved storage building/shed.
- Located behind an ACC approved privacy fence.
- Located behind an ACC approved screen.
NOTE: There are a number of community related matters that the Board does not deal with but are occasionally brought to our attention by members of the Association.
These matters are outside the scope of the HOA:
- Traffic
- Speeding
- Illegal parking
- Street lights
- Potholes & street maintenance
- Property developments outside of our boundaries
- Neighbor disputes
- Acting as a liaison to our government (except where required)
